TERMS AND CONDITIONS, INCLUDING THE RULES OF AUCTION

STANDARD TERMS AND CONDITIONS, INCLUDING THE RULES OF AUCTION, USE OF WEBSITE AND PRIVACY POLICY (COLLECTIVELY THE "TERMS AND CONDITIONS"): PLEASE READ THIS DOCUMENT CAREFULLY. YOUR USE OF THIS WEBSITE AND/OR ANY BID PLACED ON DEALERSONLINE ("THE COMPANY") CONFIRMS YOUR UNCONDITIONAL ACCEPTANCE HEREOF.

 

DEFINITIONS

1.      "Buyer" means the purchaser of the Goods;

2.      "Cleared Funds" means the approved bid purchase price paid by the Buyer into the Seller's nominated bank account, which funds are cleared by such nominated bank and to which the Seller has immediate access;

3.      "Company" means DealersOnline International FZCO;

4.      "Contract" means any contract or agreement arising out of the acceptance of any offer, whether that contract arises out of an offer made by the Company and accepted by the Customer, or an offer made by the Customer and accepted by the Company;

5.      "Effective Date" means the date of payment of the approved bid purchase price;

6.      "Goods" means the motor vehicles and/or any other item listed for sale on the Website;

7.      "its" shall include "his" and "her";

8.      "Party" shall mean either the Buyer, Seller and/or the Company as the context may apply and "Parties" shall mean a collection of the Buyer, Seller and/or the Company as the context may apply;

9.      "Reserve Price" means the minimum VAT inclusive price at which the Seller is prepared to sell the Goods;

10.   "Seller" means the seller of the Goods and may include the Company where context applies;

11.   "User" means the user, juristic or natural, of the Website and can include the Buyer and the Seller where context applies;

12.   "Website" means www.dealersonline.com .

 

THE AUCTION PROCESS

13.  Vehicles are listed to the Online Auction by Sellers no less than 24 hours before the close of an Auction.

14.  Auctions are timed thereby providing Buyers with the necessary time to research the vehicles, market related pricing as well as to physically view the vehicles.

15.  All vehicles undergo a thorough inspection process to ensure that the details provided enable the Buyer to make informed purchase decisions but are only a rough guide. The Seller & Company are not liable for any details which may differ on the physical vehicle. However, they should endeavor to inspect and document the vehicle in a true and transparent manner. Buyers are therefore urged to view all vehicles physically prior to placing bids as follows:

16.   Vehicles are listed with a Starting Bid Price which is the amount at which bidding begins and are inclusive of VAT.

17.   Bids are placed in increments of AED 350 including VAT.

18.   A buyer may place several bids enabling him/her to bid on a vehicle to the value to which he/she is willing to pay.

19.   The Auction will end when the time runs out.

20.   If a bid is placed within the last 5 minutes of the Auction, the Auction time will extend for an additional 5 minutes. This process will continue until no further bids are placed within a 5 minute period.

21.   The highest bidder will receive confirmation via email / SMS to confirm the receipt of his/her bid.

22.   The Seller will accept or decline the highest bid amount within 1 business day which will be communicated to the Buyer via email / SMS.

23.   The Seller will communicate an invoice to the Buyer within 1 business day for the accepted highest bid amount which includes VAT.

24.   The Buyer is liable to effect payment of the full invoice amount within 2 business days via bank transfer or other payment methods accepted by the Seller.

25.   On receipt of the funds into the Sellers bank account, a confirmation notice will be sent to the Buyer to proceed to collect the vehicle.

26.   The Buyer has a maximum of 2 business days to collect the vehicle and if not adhered to may lead to the Seller charging storage fees of up to AED 500 per day.

27.   It is the Buyers responsibility to transfer ownership of the vehicle into his/her name within 7 days.

 

IMPORTANT NOTICES

28.  This document contains the standard terms and conditions of auction on which the Company auctions the Goods to the User.

29.  These terms and conditions constitute the entire agreement between the Company and the User relating to the subject matter hereof and shall be binding between the parties for all current and future online auctions of Goods, unless modified and/or amended by the Company. The Seller shall in addition to being bound to these terms and conditions furthermore be bound to the Seller's mandate entered into between the Company and the Seller.

30.  The User, by its application for registration and subscription to the Website, logging in on the Website and the submission of electronic bids, warrants that it has read and understood all the terms and conditions contained in this document and agrees to be bound hereby.

31.  These terms and conditions may be periodically modified and/or amended by the Company at any time and in their sole discretion and it is the responsibility of the Users to ensure that they are familiar with the updated and/or amended terms. The User’s continued use of the Website signifies their acceptance of these terms and conditions and any updates and/or amendments thereof.

32.  These terms and conditions are subject and shall be interpreted in accordance with the provisions of the Emirate of Dubai and the UAE federal laws, as case may be, in the Emirate of Dubai. Any dispute which may arise from or in connection with these terms and conditions shall be referred to Dubai courts or by means of arbitration which shall have jurisdiction to hear settle any claim or procedure and finalize any such dispute

33.  All vehicles are sold on an As-Is basis. The Sellers with guidance from the Company strive to document all details on the Online Auction report which may not always be possible and is therefore the sole responsibility of the Buyer to physically view the vehicle before placing a bid.

 

INTRODUCTION AND COMPANY INFORMATION

34.  The Company (License Number: 4593) is in the business of offering for auction on behalf of the Seller, from time to time, motor vehicles and accessories using an electronic internet-based auction system.

35.  Information about the particular Goods on the Website is as provided by the Seller to the Company and the Company makes no representations or warranties with respect to the accuracy or completeness of any description. The responsibility for the information provided in the listing of the Goods lies with the Seller.

36.  The auctioneer is the Company, which auction takes place online, and whose registered address is situated at 4EB 733-SD09, Dubai Airport Free Zone, Dubai, UAE.

37.  A representative of the Company can be contacted at info@dealersonline.com or +971 56 274 3766.

38.  The Website is run by the Company as the core technology provider. Motor vehicles sold via the Auction belong to various sellers who have been verified by the Company. The Company does not own these vehicles and acts as a third party to conclude sales with registered buyers and sellers via the platform.

 

REGISTRATION BY THE USER

39.           The User:

a)     will complete, in full, the registration documents provided on the Website;

b)     certifies that the information provided by the User in all respects is true and correct;

c)     will furnish the Company with such supporting documentation as may be required by the Company for registration and transactional purposes;

d)     acknowledges that the bidding for any Goods on auction on the Website and any sale concluded as a result thereof will give rise to a contractual relationship between the Seller and the Buyer;

e)     agrees to receive marketing communication from the Company on behalf of Sellers via electronic channels (email, Whatsapp) and SMS.

40.  The Company reserves the right to decline or at any time cancel a User's registration for any reason whatsoever and for which the User will have no recourse.

41.  The User shall furthermore make available to the Company and/or the Seller such information as may be required by the aforementioned parties including, without limitation:

a)    Emirates ID and/or Passport copies;

b)    Company Trade License;

c)     Vat Certificate.

 

42.           The User acknowledges that the Company:

a)     is not a party to the sale of any Goods, unless where the Company is also regarded as the Seller;

b)     does not warrant that the Seller is willing and/or able to perform its obligations to the Buyer as contained herein; and

c)     will not be a party to any dispute between the Seller and the Buyer in relation to the Goods but will mediate to receive such outcome that is not biased in anyway.

 

43.           The User warrants that:

a)     upon the submission of a bid, the User is willing and able to effect payment of that sum plus any additional costs specified on the Website;

b)     it may be charged a fee for the utilization of the Website;

c)     it has not, directly or indirectly, engaged in or been involved in bid manipulation and/or unfairly induced any other person to make bids and/or alter and/or affect the bid price and/or in any way colluded with any person whomsoever, juristic or natural, to alter or attempt to alter a fair bidding process;

d)     it agrees that the successful bid shall be the final purchase price for the Goods, and it shall not negotiate the purchase price of the Goods with the Seller;

e)     it shall not contact or request the Seller to remove the Goods from auction;

f)      it has viewed and/or inspected the Goods and/or hereby waives its right to view and/or inspect the Goods and has satisfied itself as to the condition thereof;

g)     he/she is over the age of 18 (eighteen) years.

h)     he/she complies with all the provisions of laws related to information technology including the Federal Law by decree No. 5 for the year 2012, concerning protection against cybercrimes.

 

RULES OF AUCTION

44.  The Company is the auctioneer and the auction is a closed auction as defined in the Regulations.

45.  All bids placed through the Company will be submitted electronically through the Website and no alternative form of a bid will be accepted or considered valid for any reason whatsoever.

46.  Where the auction is subject to a Reserve Price, the Seller reserves the right to reject any bid below the minimum Reserve Price.

47.  As per the Federal Tax Authority (FTA) Law No. 8/2017 published by the Government of the UAE, Value Added Tax (VAT) will be added to all auction prices (where applicable) and all charges including administration fees, fines, storage fees export and delivery fees.

48.  By placing a bid, the User warrants that they have the ability and the intention to proceed with the purchase of the Goods. All successful bids placed by the User constitute an irrevocable offer by the User to the Seller and may not be withdrawn by the User, unless otherwise agreed in writing by the Seller.

49.  The Company and/or the Seller reserves the right, in its sole and absolute discretion to withdraw its listed Goods from auction at any time before or after acceptance of a bid.

 

REFUNDABLE DEPOSIT

50.  The Company has a very important role in ensuring that our Buyers and Sellers transact in a transparent and fair manner. Buyers are looking for a great deal on their stock while Sellers are looking to achieve the best returns. These can be achieved in a fair operating environment which is monitored by our team of experts.

51.  In order to participate on the Online Auction, Buyers must pay a refundable deposit of AED 3000 to the Company via bank transfer to the following account:

52.           Upon payment of a deposit, please send a proof of payment to info@dealersonline.com in order to activate your profile for bidding and include your name and mobile contacts.

53.  The deposit payment enables buyers to place bids on the Auction with no limit. Buyers are therefore cautioned to only bid within their budget and not bid on multiple vehicles unless they have the necessary funds to pay for all the vehicles in the event of the bids being accepted.

54.  Deposits are refundable at any time by simply emailing info@dealersonline.com with a request for the refund of your deposit. Please ensure to include your name, mobile, email and bank account details. The Company aim to process all refunds within the soonest timeframe however these can take up to 7 business days to reflect in your account.

55.  The collection of a deposit is to ensure that Buyers abide by the Terms & Conditions and Rules of Auction. Failure to abide by these may result in penalties of a portion or full deposit being forfeited.

 

LIMITATIONS AND INDEMNITY

56.  In addition to any other specific exclusions of liability contained herein and unless otherwise expressly stated herein, the Parties agree that the Buyer shall have no claim against the Company for any loss or damage, of any nature whatsoever, occasioned by any defect, whether patent or latent, or product liability in the Goods supplied by the Seller or any failure to provide adequate instructions in respect of any hazards that might arise from the use or incorrect use of the Goods or the User's use or inability to use any Goods sold on the Website.

57.  In the event of the breach of these terms and conditions by the Company, the User's remedies shall be limited to damages which shall under no circumstances exceed the purchase price of the Goods.

58.  The User hereby indemnifies and holds the Company harmless against any losses, expenses, costs or damages of whatsoever nature incurred by the User howsoever arising, including from any willful misconduct or gross negligence of the Company. The Company shall under no circumstances whatsoever be liable for damages, directly or indirectly caused, or consequential loss of any nature whatsoever.

59.  The User hereby indemnifies and holds the Company harmless and waives any right that it may have to claim against the Company in relation to any loss which it may suffer occasioned by the unauthorized use of the User's Website secret password and username.

إيضاحات

1-    يقصد بمصطلح "المشتري" مشتري البضاعة.

2-    يُقصد بـ "المبلغ المدفوع" سعر الشراء المعتمد الذي يدفعه المشتري في الحساب المصرفي للبائع، يتم إستلام الأموال من قبل هذا البنك المعين والذي يمكن للبائع من استلامه مباشرةً؛

3-    "الشركة" تعني DealersOnline International FZCO

4-    "العقد" يعني أي عقد أو اتفاق ينشأ عن قبول أي عرض، سواء كان ذلك العقد ناشئًا عن عرض مقدم من الشركة وتم قبوله من العميل، أو عرض مقدم من العميل و تم قبوله من قبل الشركة؛

5-    "تاريخ بدء سريان" يعني تاريخ دفع سعر شراء المزايدة المعتمد؛

6-     "البضائع" تعني المركبات و / أو أي عنصر آخر مدرج للبيع على الموقع الإلكتروني؛

7-    "إنها" يجب أن تشمل "له" و "لها"؛

8-    "الطرف" يعني إما المشتري و / أو البائع و / أو الشركة حسب السياق، "الأطراف" تعني مجموعة من المشترين و / أو البائعين و / أو الشركة حسب السياق؛

9-    "السعر الاحتياطي" يعني الحد الأدنى للسعر الشامل لضريبة القيمة المضافة الذي يكون البائع مستعدًا لبيع البضاعة به؛

 

10- "البائع" يعني بائع البضاعة ويمكن أن يشمل الشركة حيثما ينطبق ذلك؛

11- "المستخدم" يعني المستخدم القانوني أو الطبيعي، للموقع ويمكن أن يشمل المشتري والبائع حيثما ينطبق ذلك؛

12- "الموقع" يعني www.dealersonline.com

 

 

سير عملية المزاد

13- يتم إدراج المركبات في المزاد عبر الإنترنت من قبل البائعين قبل 24 ساعة على الأقل من موعد إغلاق المزاد

14- يتم تحديد مواعيد للمزادات حيث ذلك يمكن من توفير الوقت الكافي للمشترين للبحث عن المركبات، ودراسة أسعار المركبات في السوق وكذلك لمعاينة المركبات بشكل مادي

15- تخضع جميع المركبات لعملية فحص شاملة للتأكد من أن التفاصيل المقدمة تمكن المشتري من اتخاذ قرارات شراء صحيحة، ولكنها مجرد دليل تقريبي. ولا يتحمل البائع أو الشركة أي مسؤولية عن أية تفاصيل قد تختلف عن التفاصيل الفعلية للسيارة، علماً أن البائعون والشركة يبذلون قصارى جهدهم لفحص وتوثيق تفاصيل السيارة بطريقة صحيحة وشفافة. لذلك نحث المشترين على معاينة جميع المركبات فعليًا وبشكل مادي قبل تقديم المزايدات على النحو التالي

17- السيارات مدرجة بسعر المزايدة الافتتاحي وهو المبلغ الذي تبدأ به المزايدة ويشمل ضريبة القيمة المضافة

18- عند كل مزايدة يتم ارتفاع السعر بمقدار 350 درهمًا شاملة ضريبة القيمة المضافة

19- يحق للمشتري أن يقدم عدة مزايدات تمكنه من المزايدة على مركبة بالقيمة التي يرغب في دفعها.

20- ينتهي المزاد بانتهاء الوقت المحدد.

21- إذا تم تقديم مزايدات خلال آخر 5 دقائق من انتهاء وقت المحدد لمزاد، فإن وقت المزاد سيمتد لمدة 5 دقائق إضافية. ستستمر هذه العملية الى ان يتم توقف أية مزايدات أخرى خلال فترة 5 دقائق.

22- يتلقى صاحب أعلى مزايدة بريد الإلكتروني / رسالة نصية لتأكيد باستلام مزايدته / مزايدتها

23- سيقبل البائع أو يرفض أعلى مبلغ مزايدة خلال يوم عمل واحد والذي سيتم إبلاغه للمشتري عبر البريد الإلكتروني / رسالة نصية

24- سيقوم البائع بإرسال فاتورة إلى المشتري في غضون يوم عمل واحد لأعلى مبلغ مزايدة مقبول من البائع والذي يتضمن ضريبة القيمة المضافة.

25- يتحمل المشتري مسؤولية دفع مبلغ الفاتورة بالكامل في غضون يومي عمل عن طريق التحويل المصرفي أو طرق الدفع الأخرى التي يقبلها البائع.

26- عند استلام الأموال في الحساب المصرفي للبائع، سيتم إرسال إشعار تأكيد إلى المشتري للمضي قدمًا في عملية استلام السيارة.

27- لدى المشتري يومي عمل كحد أقصى لاستلام السيارة، وإذا لم يتم الالتزام بذلك، فقد يؤدي هذا إلى فرض رسوم تخزين على المشتري من قبل البائع تصل إلى 500 درهم إماراتي في اليوم.

28- يتحمل المشترون مسؤولية نقل ملكية السيارة إلى اسمه / اسمها في غضون 7 أيام.

 

ملاحظات هامة

29- يحتوي هذا المستند على الشروط والأحكام القياسية للمزاد الذي به تقوم الشركة بالمزايدة على البضائع من خلاله للمستخدم.

30- تشكل هذه الشروط والأحكام الاتفاقية الكاملة بين الشركة والمستخدم فيما يتعلق بالموضوع المذكور هنا وتكون ملزمة بين الأطراف لجميع مزادات البضائع الحالية والمستقبلية عبر الإنترنت، ما لم يتم تغيرها و / أو تعديلها من قبل الشركة. بالإضافة الى الالتزام بهذه الشروط والأحكام، علاوةً على ذلك يجب على البائع الالتزام رسمياً والتقيد بالتفويض المبرم بين الشركة والبائع.

 

 

31- يقر المستخدم، من خلال طلبه للتسجيل والاشتراك في الموقع، وتسجيل الدخول على الموقع وتقديم المزايدات الإلكترونية، أنه قد قرأ وفهم جميع الشروط والأحكام الواردة في هذه الوثيقة ويوافق على الالتزام بها.

32- يجوز تعديل هذه الشروط والأحكام و / أو تعديلها بشكل دوري من قبل الشركة في أي وقت ووفقًا لتقديرها الخاص وتقع على عاتق المستخدمين مسؤولية التأكد من أنهم على دراية بالشروط المحدثة و / أو المعدلة. يدل استخدام المستخدم المستمر للموقع على قبوله لهذه الشروط والأحكام وأي تحديثات و / أو تعديلات عليها.

33- تخضع هذه الشروط والأحكام ويتم تفسيرها وفقًا لأحكام إمارة دبي والقوانين الاتحادية لدولة الإمارات العربية المتحدة، حسب الحالة، في إمارة دبي. يُحال أي نزاع قد ينشأ عن أو فيما يتعلق بهذه الشروط والأحكام إلى محاكم دبي التي تتمتع بالاختصاص للنظر في تسوية أي مطالبة أو إجراء وإنهاء أي نزاع من هذا القبيل

34- تُباع جميع المركبات على وضعها الحالي. يبذل البائعون جهودهم بتوجيه من الشركة لتوثيق جميع التفاصيل في تقرير المزاد عبر الإنترنت والذي قد لا يكون دائمًا ممكنًا، وبالتالي فإن المشتري هو المسؤول الوحيد عن معاينة السيارة بشكل مادي قبل القيام بعملية المزايدة.

 

 

مقدمة ومعلومات عن الشركة

35- تعمل الشركة في تقديم عروض للمزاد نيابة عن البائع، من وقت لآخر ، للسيارات وملحقاتها باستخدام نظام المزاد الإلكتروني القائم على الإنترنت. (رقم الترخيص: 4593)

36- المعلومات المتعلقة بالبضائع المعروضة على الموقع الإلكتروني هي المعلومات المقدمة من البائع إلى الشركة ولا تقدم الشركة أي تعهدات أو ضمانات فيما يتعلق بدقة أو اكتمال أي وصف. تقع مسؤولية المعلومات الواردة في قائمة البضائع على عاتق البائع.

37- البائع بالمزاد هو الشركة التي تُجري المزاد عبر الإنترنت، وعنوانها المسجل المنطقة الحرة بمطار دبي، دولة الإمارات العربية المتحدة  EB 733-SD094

38- يمكن الاتصال بممثل الشركة على: info@dealersonline.com                           أو             3766 274 56 971+     

39- يتم تشغيل الموقع من قبل الشركة كمزود أساسي للتكنولوجيا. تنتمي السيارات المباعة عبر المزاد إلى بائعين مختلفين تم التحقق منهم من قبل الشركة. لا تمتلك الشركة هذه المركبات وتعمل كطرف ثالث لإتمام المبيعات مع المشترين والبائعين المسجلين عبر المنصة.

 

التسجيل من قبل المستخدمين

40- المستخدم:

  أ) يجب على المستخدم اتمام جميع وثائق التسجيل المقدمة على الموقع بالكامل؛

 ب) يقر المستخدم بأن المعلومات التي قدمها صحيحة ودقيقة من جميع النواحي؛

    ج) يجب على المستخدم تزويد الشركة بالمستندات الداعمة التي قد تطلبها الشركة لأي سبب من   الأسباب بما في ذلك، على سبيل المثال لا الحصر.

د‌)      يقر المستخدم بأن المزايدة على أي سلع معروضة بالمزاد على الموقع وأي بيع يتم نتيجة لذلك سيؤدي إلى علاقة تعاقدية بين البائع والمشتري.

هـ) يوافق على تلقي اتصالات تسويقية من الشركة نيابة عن البائعين عبر القنوات الإلكترونية (البريد الإلكتروني، Whatsapp) والرسائل النصية القصيرة.

 

 -41تحتفظ الشركة بالحق في رفض أو إلغاء تسجيل المستخدم في أي وقت لأي سبب من الأسباب ولا يحق للمستخدم الاعتراض.

42- علاوة على ذلك، يوفر المستخدم للشركة و / أو البائع المعلومات التي قد تطلبها الأطراف المذكورة أعلاه بما في ذلك، على سبيل المثال لا الحصر:

        أ) صورة الهوية الإماراتية و / أو جواز السفر

               ب) الرخصة التجارية للشركة

               ج) شهادة ضريبة القيمة المضافة

 

        43- يقر المستخدم بأن الشركة:

   أ) ليست طرفًا في بيع أية بضائع، ما لم تعتبر الشركة نفسها انها بائع ايضا.

 ب) لا تضمن أن البائع مستعد و / أو قادر على أداء التزاماته تجاه المشتري كما هو وارد هنا؛

   ج) لن تكون الشركة طرفًا في أي نزاع بين البائع والمشتري فيما يتعلق بالبضائع، ولكنها ستتوسط للحصول على حلول غير منحازة بأية حال من الأحوال.

 

44- يضمن المستخدم ما يلي:

أ‌)      عند تقديم المزايدات، يكون المستخدم مستعدًا وقادرًا على دفع هذا المبلغ بالإضافة إلى أي تكاليف إضافية محددة على الموقع؛

ب‌)  قد يتم فرض رسوم مقابل استخدام الموقع؛

ج) يقر المستخدم انه لم يشارك أو تشارك بشكل مباشر أو غير مباشر في التلاعب بالمزايدات و / أو حث أي شخص آخر بشكل غير عادل على تقديم المزايدات و / أو تغيير و / أو التأثير على سعر المزايدات و / أو التواطؤ بأي شكل من الأشكال مع أي شخص أياً كان، قانونيا أو طبيعيا، لتغيير أو محاولة تغيير عملية المزايدات العادلة؛

     د) يوافق المستخدم على أن تكون المزايدة الفائزة هي سعر الشراء النهائي للبضائع، ولا يجوز له التفاوض بشأن سعر شراء آخر للبضائع مع البائع؛

    هـ) لا يجوز للمستخدم الاتصال أو مطالبة البائع بإزالة البضائع من المزاد؛

     و) يقر المستخدم بأنه قد اطلع و / أو قام بفحص البضائع و / أو تنازل بموجب هذا عن حقه في عرض   و / أو فحص البضائع واقتنع بحالتها على وضعها الراهن؛

    ز) يجب على المستخدم ان يكون عمره / عمرها قد تجاوز 18 (ثمانية عشر) عامًا.

   ح) يقر المستخدمون بالتزام بكافة أحكام القوانين المتعلقة بتقنية المعلومات بما في ذلك المرسوم بقانون اتحادي رقم 5 لسنة 2012 بشأن الحماية من الجرائم الإلكترونية.

 

مبادئ المزاد

45- الشركة هي الدلّال، والمزاد هو مزاد مغلق على النحو المحدد في اللائحة.

46- سيتم تقديم جميع المزايدات من خلال الشركة إلكترونيًا من خلال الموقع الإلكتروني ولن يتم قبول أي نموذج بديل للمزاد أو اعتباره صالحًا لأي سبب من الأسباب.

47- عندما يكون المزاد خاضعًا لسعر احتياطي، يحتفظ البائع بالحق في رفض أي مزايدة أقل من الحد الأدنى لسعر الاحتياطي.

48- وفقًا لقانون الهيئة الاتحادية للضرائب (FTA) رقم 8/2017 الصادر عن حكومة دولة الإمارات العربية المتحدة، ستتم إضافة ضريبة القيمة المضافة (VAT) إلى جميع أسعار المزاد (عند الاقتضاء) وجميع الرسوم بما في ذلك الرسوم الإدارية والغرامات ورسوم التصدير ورسوم التخزين.

49- من خلال تقديم المزايدة، يضمن المستخدم أن لديه القدرة والنية على المضي في شراء البضائع. تشكل جميع المزايدات الناجحة التي يقدمها المستخدم عرضًا نهائيًا من المستخدم للبائع ولا يجوز للمستخدم سحبه، ما لم يتفق مع البائع على خلاف ذلك بشكل موثّق.

         50- تحتفظ الشركة و / أو البائع بالحق، وفقًا لتقديرها المطلق، في سحب البضائع المدرجة من المزاد في أي وقت قبل أو بعد قبول المزايدة.

 

 

مبلغ الإيداع/التأمين قابل للاسترداد

51- تقوم الشركة بدورًا مهمًا للغاية في ضمان تعامل المشترين والبائعين لدينا بطريقة شفافة وعادلة. يبحث المشترون عن قدر كبير من مخزون السيارات الخاص بهم بينما يتطلع البائعون إلى تحقيق أفضل العوائد. يمكن تحقيق ذلك في بيئة تشغيل عادلة يتم مراقبتها من قبل فريق الخبراء لدينا.

52- من أجل المشاركة في المزاد عبر الإنترنت، يجب على المشترين دفع وديعة قابلة للاسترداد بقيمة 3000 درهم إلى الشركة عن طريق التحويل المصرفي على النحو التالي:

53- عند دفع مبلغ الإيداع/التأمين، يرجى إرسال إيصال إثبات الدفع إلى: info@dealersonline.com من أجل تفعيل ملفك الشخصي لتقديم المزايدات وإدراج اسمك وجهات اتصال هاتفك المحمول.

54- إن دفع مبلغ الإيداع/التأمين يمكّن المشترين من تقديم مزايدات في المزاد بلا حدود. لذلك يتم تحذير المشترين لتقديم مزايدات فقط في حدود ميزانيتهم ​​وعدم المزايدة على سيارات متعددة ما لم يكن لديهم الأموال الكافية لدفع ثمن جميع المركبات في حالة قبول المزايدات.

55- مبلغ الإيداع/التأمين قابل للاسترداد في أي وقت بمجرد إرسال بريد إلكتروني إلى info@dealersonline.com مع طلب استرداد مبلغ الإيداع/التأمين الخاص بك. يرجى التأكد من تضمين الاسم ورقم الهاتف والبريد الإلكتروني وتفاصيل الحساب المصرفي. تهدف الشركة إلى إعادة جميع المبالغ المستردة في أقرب إطار زمني، ولكن قد يستغرق ذلك ما يصل إلى 7 أيام عمل حتى يصل المبلغ الى حسابك.

56- إن تحصيل مبلغ الوديعة/التأمين هو لضمان التزام المشترين بشروط وأحكام وقواعد المزاد. قد يؤدي عدم الالتزام بهذه الشروط والأحكام إلى اقتطاع جزء أو كامل المبلغ.

 

 

القيود والتعويضات

57- بالإضافة إلى أي استثناءات محددة أخرى للمسؤولية الواردة في هذه الوثيقة، وما لم يُنص على خلاف ذلك صراحةً في هذه الوثيقة، يتفق الطرفان على أن المشتري لن يكون لديه أي مطالبة ضد الشركة عن أي خسارة أو ضرر، من أي نوع كان، ناجمًا عن أي عيب، سواء براءة اختراع أو مسؤولية كامنة أو عن المنتج في البضائع الموردة من قبل البائع أو أي فشل في تقديم تعليمات كافية فيما يتعلق بأي مخاطر قد تنشأ عن الاستخدام أو الاستخدام غير الصحيح للبضائع أو استخدام المستخدم أو عدم قدرته على استخدام أي سلع تم بيعها الموقع.

58- في حالة خرق الشركة لهذه الشروط والأحكام، فإن تعويضات المستخدم ستقتصر على الأضرار التي يجب ألا تتجاوز تحت أي ظرف من الظروف سعر شراء البضائع.

59- يعوض المستخدم بموجب هذا ويحافظ على الشركة من أي خسائر، أو نفقات، أو تكاليف، أو أضرار من أي نوع يتكبدها المستخدم مهما كانت، بما في ذلك أي سوء سلوك متعمد أو إهمال جسيم من الشركة. لا تتحمل الشركة تحت أي ظرف من الظروف أي مسؤولية عن الأضرار، التي تحدث بشكل مباشر أو غير مباشر، أو الخسارة التبعية من أي نوع كانت.

60- يعوض المستخدم بموجب هذا مع الحفاظ على عدم الحاق اي ضرر بالشركة ويتنازل عن أي حق قد يتعين عليه المطالبة به ضد الشركة. فيما يتعلق بأي خسارة قد تكبدها نتج  بسبب الاستخدام غير المصرح به لكلمة المرور واسم المستخدم السري لموقع المستخدم.
